General rental conditions

• Start and end point is from the Ferry Port in Dragør. Please see map at the bottom of the page.
• Arrive 15 minutes before your rental starts so you have time to get a good briefing about rental conditions.
• Each rented hour consists of 55 minutes of sailing, from sailing out and back again by boat.
• The boat is approved for 6 people, but it is only rented out to 4 adults and a child as a maximum This maximum is intended for a comfortable trip for everyone
• The journey on the rafts, the bridge and in the boats is at your own risk.
• It is a requirement to have life jackets on board for everyone. There is no obligation to wear life jackets, but it is recommended.
• We do not allow bachelorette parties in our boats.
• Any kind of open fire on board, be it barbecue, hookah, firing fireworks, candles and / or tealights, etc., is not allowed.
• The boats may not be used for commercial use without permission from WeSail.
• Sound moves unhindered over water, therefore music systems and large speakers on board are not allowed. Small portable speakers are of course allowed.

You are the captain on board with these requirements

• It does not require a certificate or previous experience to sail our boats, the driver just has to be mine. 18 years and must not be under the influence of alcohol or other drugs.
• A valid photo ID or passport must be brought.
• The boat must remain under supervision and the driver must not leave the boat.
• The driver must be available by mobile phone during the entire rental period.
• The driver is obliged to stay informed at all times about his position on the tablet computer he has brought with him. The driver must also agree with WeSail in which area on the map he may move with the rented boat. Yellow marked area is for experienced sailors and red area is forbidden for everyone.
• For your safety, WeSail keeps an eye on where you are sailing.
• Unless otherwise agreed with WeSail, all sailing must be limited to a box defined as: south of Nordre Røse, north of Sydvestpynten, and west of Peberholmen. In addition, any traffic in the fairway must be restricted.
• It is your responsibility as the master of the boat to comply with applicable rules.

If the accident is out: Liability and compensation

• If there is an accident, call WeSail on 93872458 immediately. We may be able to come to your rescue in our lifeboat
• If the boat, engine and equipment are not returned in the same condition, the tenant can be held liable in accordance with the general compensation rules of Danish law.
• Any action in violation of these Terms and Conditions shall be deemed to be a negligent act.
• Tenant undertakes to compensate any loss due to damage to the boat and equipment, however, a maximum of DKK 8,000.00. However, if the damage has occurred as a result of gross negligence or willful conduct, the full claim can be directed against the tenant.
• Tenant is obligated to reimburse any expense in connection with search of the boat, see also the section below on delay.
• If the tenant is sailed on, the tenant undertakes to obtain information about insurance from the tortfeasor, as the tenant has full responsibility for the boat. The tenant must immediately notify WeSail of damage to the boat and pass on information about what happened.
• If the tenant damages other people's property while sailing, the tenant has a duty to exchange information with the injured party. Landlord is without liability in any respect for the damage caused by the tenant to third party property.
• Cleaning fee of DKK 250 can be charged if the boat is not returned in tidy condition.

Take care of yourself and yours: Sailing rules

• Applicable rules for sailing must be observed.
• Always hold back for larger vessels.
• Show consideration for other boats and always keep a good distance.
• All sailing in the industrial port of Dragør is prohibited. Also keep a good distance to the Pilot Boat. Its view and undulating can be a challenge.
• WeSail is in favor of good neighborliness, please help to live up to it.

If you arrive late: Delay

• In the event that the tenant can not return with the boat at the agreed time, the tenant must immediately contact WeSail on tel. 93 87 24 58. A 15-minute radius from the Ferry Port is marked on the map.
• WeSail reserves the right to collect DKK 100 per commenced 15 minutes after the original time of entry.
• If the delay is the reason for the search, the cost of this is paid by the tenant.

Money, cards, cash: Payment

• All prices include VAT.
• On our raft, we accept most payment methods: MobilePay, all cards from Visa, MasterCard and Maestro
• Payment is deducted on arrival at WeSail and refunded according to cancellation policy.
• We make reservations for any. errors in the booking system. See on our website the current prices

We hope it does not happen: Cancellation and cancellation

• Cancellation must be made by sending an email to info@wesail.dkwith information about name, telephone number and email address.
• In the event of sudden situations with increased risk when sailing, the landlord has the right and not least the duty to cancel the booking. This entails a full refund if the rent is prepaid.
• Tenant is not entitled to compensation in case of cancellation of rental due to weather conditions, missing vessel due to theft or other unforeseen circumstances. Prepaid rent and any deposit will of course be refunded in these cases.
• Landlord may at any time refuse or cancel rental if it is deemed unreasonable to rent or if the above rules are not complied with. Prepaid rent will not be refunded if there are less than 24 hours to the start of the booking.

The small print: Limitation of liability

• WeSail's liability must be limited to a maximum amount corresponding to the fees paid by the tenant in accordance with these terms of use, or if no fees have been received, then DKK 1,000.
• WeSail is under no circumstances responsible, whether or not a claim is made
  compensation in or out of contract, or otherwise for random; indirectly, consequential damages or unforeseeable losses, damages or costs, loss of profits, loss of business, loss of opportunities, loss or corruption of data, however, occur even if they are notified of the possibility that such loss or damage occurs.

That with even less writing: Venue and choice of law

• The agreement is subject to Danish law, but not Danish choice of law rules if this results in a choice of law other than Danish law.
• Any dispute that may arise in connection with this agreement, including disputes regarding the existence or validity of the agreement, shall be settled by the Copenhagen City Court.
